Student group to go to court over Facebook privacy policy












VIENNA (Reuters) – An Austrian student group plans to go to court in a bid to make Facebook Inc, the world’s biggest social network, do more to protect the privacy of its hundreds of millions of members.


Campaign group europe-v-facebook, which has been lobbying for better data protection by Facebook for over a year, said on Tuesday it planned to go to court to appeal against decisions by the data protection regulator in Ireland, where Facebook has its international headquarters.












The move is one of a number of campaigns against the giants of the internet, which are under pressure from investors to generate more revenue from their huge user bases but which also face criticism for storing and sharing personal information.


Internet search engine Google, for example, has been told by the European Union to make changes to its new privacy policy, which pools data collected on individual users across its services including YouTube, gmail and social network Google+, and from which users cannot opt out.


Europe-v-facebook has won some concessions from Facebook, notably pushing it to switch off its facial recognition feature in Europe.


But the group said on Tuesday the changes did not go far enough and it was disappointed with the response of the Irish Data Protection Commissioner (DPC), which had carried out an audit after the campaign group filed numerous complaints.


Facebook, due to hold a conference call later on Tuesday to answer customer concerns about its privacy policy, said its data protection policies exceeded European requirements.


“The latest Data Protection report demonstrates not only how Facebook adheres to European data protection law but also how we go beyond it, in achieving best practice,” a Facebook spokesman said in an emailed comment.


“Nonetheless we have some vocal critics who will never be happy whatever we do and whatever the DPC concludes.”


LOSING PATIENCE


Europe-v-facebook founder Max Schrems, who has filed 22 complaints with the Irish regulator, said more than 40,000 Facebook users who had requested a copy of the data Facebook was holding on them had not received anything several months after making a request.


“The Irish obviously have no great political interest in going up against these companies because they’re so dependent on the jobs they create,” Schrems told Reuters.


Gary Davies, Ireland’s deputy data protection commissioner, denied Facebook’s investment in Ireland had influenced regulation of the company.


“We have handled this in a highly professional and focused way and we have brought about huge changes in the way Facebook handles personal data,” he told Reuters.


Schrems also questioned why Facebook had only switched off facial recognition for users in the European Union, even though Ireland is the headquarters for all of Facebook’s users outside the United States and Canada.


Facebook is under pressure to reverse a trend of slowing revenue growth by selling more valuable advertising, which requires better profiling of its users.


Investors are losing patience with the social network, whose shares have dropped 40 percent in value since the company’s record-breaking $ 104 billion initial public offering in May.


Last month, Facebook proposed to combine its user data with that of its recently acquired photo-sharing service Instagram, loosen restrictions on emails between its members and share data with other businesses and affiliates that it owns.


Facebook is also facing a class-action lawsuit in the United States, where it is charged with violating privacy rights by publicizing users’ “likes” without giving them a way to opt out.


A U.S. judge late on Monday gave his preliminary approval to a second attempt to settle the case by paying users up to $ 10 each out of a settlement fund of $ 20 million.


Europe-v-facebook said it believed its Irish battle had the potential to become a test case for data protection law and had a good chance of landing up in the European Court of Justice.


Schrems said the case could cost the group around 100,000 euros ($ 130,000), which it hoped to raise via crowd-funding – money provided by a collection of individuals – on the Internet.

Oscars Flashback: Steven Spielberg 1994

Hailed filmmaker Steven Spielberg has one of the most beloved bodies of work in film history, but it took him some time to witness his hard work become cast in shiny medal at a major awards ceremony. However, the deep resonation of Schindler's List amongst audiences and critics helped him win his first Oscars in 1994.

A professional filmmaker since the late '60s, Spielberg had been in the business for a while and had been putting out hit films from The Blues Brothers to E.T. the Extra-Terrestrial to Back to the Future, but he had yet to receive an Oscar for his work despite five nominations and an honorary Oscar as a producer.

Spielberg not only won his first Oscar in 1994 for the Holocaust-based Schindler's List but won his first two Oscars that night, adding Best Picture to his Best Director Award. Although he was joyful to have won the award, he was reminded in the pressroom of his initial hesitation in making the film after buying the rights to the story.

"I was very intimidated by the subject matter when I first read the book... I was just intimidated by the responsibility," he reflects in the flashback. "I just wasn't ready. Sometimes you're just not ready for these things...I woke up one morning and I said to Kate (wife), 'I've got to make 'Schindler's List,' and she said, 'Where did that come from?' and I said, 'I don't know, but I just have to make it.'"

While the influence of Spielberg waiting to take on the final product of Schindler's List will never be known, it never seemed a more brilliant decision for him as he stood there with fistfuls of polished trophies. After waiting years for that very moment, Spielberg reflected on the win.

"I could have dealt with never winning an Academy Award because I had practiced dealing with it for the last twelve years," he says. "So, this was a wonderful honor tonight. If I hadn't have gotten it, I probably would have been shattered...It's just great to win. It's just wonderful to win. I think all of us feel that way."

Lawyer Dominic Barbara busted for stalking, attempted extortion of ex-wife: Rice

Lawyer Dominic Barbara has been arrested and charged with harassment, stalking and trying to extort $200,000 from his ex-wife – with alleged dirty pictures, says Nassau County DA Kathleen Rice.

Barbara, 67, was busted today for attempted fourth degree grand larceny, second degree aggravated harassment and fourth degree stalking. He will be arraigned later today at Nassau County First District Court in Hempstead.

"This was a cold-hearted campaign of harassment and threats, designed to put money in the defendant’s pockets and he didn’t care how many lives he destroyed along the way," said Rice.




"Mr. Barbara’s conduct indicates a complete lack of respect for the people he maligned, the rule of law and common decency,’’ Rice said.

Rice said that from March to September of this year, Barbara, who is suspended from the practice of law, texted and called his former wife Leslie Barbara demanding $10,000.

When she refused, he is charged with beginning a campaign of threats that he would destroy her reputation and career by exposing details of his wife’s alleged sexual relationships, Rice said.

The infamous media hound threatened to hold a press conference and release compromising photos and claims of her alleged sex life. Barbara also warned he would file false court papers on the alleged sex hijinx – and upped his demand to $200,000.

He claimed he had photographic proof that Leslie Barbara was having an intimate relationship with her boss at her law firm and threatened to send those alleged pictures to the man’s wife.

Barbara at one point confronted his ex at a beauty salon and threatened her that "things are going to get a lot worse."

Barbara faces up to a year behind bars, if convicted.

The business behind the artist: Miami’s art gallery scene still evolving




















This week, thousands of art collectors, museum trustees, artists, journalists and hipsters from around the globe will arrive for the phenomenon known as Art Basel Miami Beach. The centerpiece of the week: works shown at the convention center by more than 260 of the world’s top galleries.

Only two of those are from Miami.

While Art Basel has helped transform the city’s reputation from beach-and-party scene to arts destination in the years since its 2002 Miami Beach debut, the region’s gallery identity is still coming into its own.





“Certainly Miami as an art town registers mightily because of the foundations, the collectors who have done an extraordinary job,” said Linda Blumberg, executive director of the Art Dealers Association of America. “I think there’s a definite international awareness there. But the gallery scene probably has a bit of a ways to go. That doesn’t mean it’s not really fascinating and interesting.”

The gallery business, especially where newer artists are concerned, is a game of risk, faith and passion. Once a gallery takes on an artist who shows promise, they become an evangelist on their behalf, showing their work in-house and at fairs, presenting it to museums and curators and potential collectors and bearing the cost of that promotion.

For contemporary artists, most galleries take work on consignment, meaning they get a cut of as much as 50 percent when works sell. While local art galleries have been growing in number and popularity in the last several years — just try to find parking during the monthly art walk in Miami’s hot Wynwood neighborhood — even some of the area’s top art dealers say that while business overall is good, they struggle in the local marketplace.

“Our problem is that we have to do lots of art fairs in order to connect with the market that we need to connect with to sell the work that we have,” said Fredric Snitzer, a Miami-Dade gallery owner for 35 years. “The better the work is, the harder it is to sell in Miami. And that ain’t good.”

A handful of serious collectors call Miami home and store their own collections in Miami, including the Braman, Rubell, Margulies and de la Cruz families. But outside a relatively small local group, many gallerists say, their clients come from other parts of the country and world.

And some gallerists point out the troubling reality that even the powerhouse Galerie Emmanuel Perrotin could not stay open in Miami for more than a few years.

“The fact that big galleries have not been able to sustain their business models in South Florida tells you we’re obviously not at this high established point,” said gallery owner David Castillo. “It’s not like we’ve arrived, let’s sit back and watch Hauser & Wirth open down the street.”

Still, Miami’s gallery business has come a long way since the early 1970s, when a few dealers on Bay Harbor Island’s Kane Concourse were selling high-end pieces but the local scene was hardly embraced.

Virginia Miller, who owns ArtSpace/Virginia Miller Galleries in Coral Gables, first opened in 1974 to showcase Florida artists, though her focus soon added an international scope. She and other longtime observers credit several factors for Miami’s transformation, including the community’s diversity, the establishment of important museums, the Art Miami fair that started 23 years ago, the presence of major collections and, of course, Art Basel Miami Beach.

Miami-Dade proposes spending $1.5 billion over 15 years to cure sewer system woes




















Six months into negotiations with federal regulators over Miami-Dade’s aging sewer system, the county has come up with a $1.5 billion, 15-year plan to rebuild pipes, pumps and sewage treatment plants that in some cases are almost 100 years old.

County leaders devised the proposal in an attempt to fend off a federal lawsuit, and potentially millions of dollars in fines, for not abiding by the federal Clean Water Act. The county also has proposed replacing or repairing a good portion of the 7,500 miles of sewer lines that regularly rupture and spill millions of gallons of raw waste into local waterways and Biscayne Bay.

Before any work is to begin, the Department of Justice and Environmental Protection Agency — which put the county on notice in May — must accept the county’s terms. The plan, referred to as a consent decree, also must be endorsed by a majority of county commissioners. That could come as soon as late January or early February.





One of the largest repair jobs would be a $555 million reconstruction of the controversial wastewater treatment plant on Virginia Key. Entire concrete structures would be rebuilt, and pump stations and electrical systems would be replaced. The plan calls for spending another $394 million on similar fixes to two other wastewater treatment facilities, in Goulds and North Miami.

Another $408 million would be spent replacing and rehabbing the county’s 1,035 pump stations, and miles of transmission lines that run to and from the plants.

The plan has already garnered some criticism.

The Biscayne Bay Waterkeepers, clean-water activists who filed to join the federal action against the county, say spending hundreds of millions of dollars to rebuild on Virginia Key is a waste, because the spit of land is likely to be under water within 50 years.

The group points to a recent study by the journal Science that showed the polar ice caps in Greenland are melting at three times the rate originally believed. They also say a climate change compact Miami-Dade agreed to with three other counties — which accepted a U.S. Army Corps of Engineers study that shows sea levels will rise 3 feet by 2060 — shows the Virginia Key plant could be in peril.

“Doubling down on Virginia Key the way they’re doing it is just stupid,” said environmental attorney Albert J. Slap, representing the Waterkeepers. “There’s not a dime in it for armoring the plant, or raising it. It’s on a barrier island.”

Doug Yoder, deputy director of the county’s water and sewer department, didn’t dispute the Army Corps findings, and said the county could abandon the Virginia Key plant for a new plant on the western edge of the county if federal regulators make such a demand.

“We certainly don’t want to spend a lot of money fixing up a facility we’ll soon abandon,” he said.

Most of the costs for the overall plan will be covered through county revenue bonds, Yoder said, meaning a future increase in water rates and debt service bills. Miami-Dade Mayor Carlos Gimenez has been warning for months that rate hikes are in the offing.

To meet demands from the feds, the county also must abandon by 2027 an outflow system it now uses that dumps up to 120 million gallons of sewage each day miles offshore. The county has until July 2013 to come up with an alternate disposal method.

A project cited in the new plan that had not been publicly addressed previously is the installation of 7,660 linear feet of sewer mains in an industrial area just below State Road 112 and between Northwest 27th and 37th avenues, which now depends on septic tanks. The job of hooking up local businesses there to county sewers would cost a little over $2 million.

Federal regulators began talks with Miami-Dade in May after a series of massive raw sewage spills released more than 47 million gallons of untreated human waste throughout the county. DOJ and the EPA, along with the Florida Department of Environmental Protection, sketched out the 78-page consent decree.

Four times between October and December 2011, the sewage treatment plant on Virginia Key alone ruptured, spilling more than 19 million gallons.

The county also has agreed to pay a $978,000 fine for past spills within 30 days of the plan being accepted, with about half the money going to the DOJ and the other half to the state.

DOJ spokesman Wyn Hornbuckle declined to comment Friday.

In October, the county denied 12 permit applications in the Coconut Grove area by businesses that wanted to install sinks, toilets or showers. The county said it was imposing a moratorium on new sewage outflow from a Coconut Grove-serving pump station.

Val Chmerkovskiy on 'Dancing with the Stars' Season 15

Now that Dancing with the Stars is over, professional dancer Val Chmerkovskiy is revealing his retrospective thoughts on his third season on the show, which concluded in a third-place ending for him and actress Kelly Monaco. Chmerkovskiy developed a tight relationship with Monaco over the season, but admits that he had his sights on another partner in the beginning.

Chmerkovskiy originally joined his brother Maks on the celebrity dancing show as a pro dancer for Season 13, eventually placing eleventh with Italian actress Elisabetta Canalis. After placing tenth with Sherri Shepherd the following season, he became discouraged and secretly aspired to be paired with one of the All-Stars season's least capable dancers.

"Going into the season, I had very different views and my imagination was taking me in a different way. My expectations were very, very different," the 26-year-old Latin dance specialist said. "I was really happy to the idea of Bristol Palin, only because I was so discouraged with my last two seasons."

The Ukraine native then explained that he was daunted by the show's first All-Stars season, which was packed with six former Mirrorball Trophy winners, and if he were to lose with a less capable dancer like Palin, the responsibility for be eliminated would lie with his partner and not him.

Palin eventually finished in ninth place with Mark Ballas after four weeks of dwelling at the bottom of the leader board. While finishing ninth would have been a slight improvement for Chmerkovskiy, he instead made a drastic leap and danced with Monaco to his first finals.

While fan voters typically vote for the show's celebrities, Val's skin-flashing performances, including stripping down to a Speedo in the pair's "surfer flamenco," may have carried the two throughout the weeks despite scores that generally hovered around the middle of the leader board.

Although the show is now over, Chmerkovskiy will be putting his half-naked body on display once again in an upcoming guest role on General Hospital, on which Monaco has starred since 2003 and acted in over a thousand episodes. While he's been criticized for continually taking his shirt off on TV, Chmerkovskiy claims it's not his idea to do so.

"I'm getting all the [flak] for it like it's my idea. They told me specifically, 'Show up [with] no shirt; you're coming out of a gym,'" he said. "I'm just doing what people ask. I'm giving the people what they want."

Pope joins tweeting masses with Pontifex handle

VATICAN CITY — Benedict XVI, the pope known for his hefty volumes of theology, is now trying brevity — spreading the faith through his own Twitter account.

The pontiff will tweet in eight languages starting Dec. 12 using his personal handle @Pontifex, responding live to questions about faith during his weekly general audience, the Vatican said Monday.

Questions can be submitted to #askpontifex, and the pope will likely respond to three to five of those sent from around the world, the Vatican's communications adviser Greg Burke told a news conference.

The pope sent his first tweet last year from a Vatican account to launch the Holy See's news information portal, part of efforts to increase the church presence in social media and spread the faith. A personal Twitter account for the 85-year-old Benedict has been the subject of speculation ever since; Monday's news conference was packed in an indication of the interest it has generated.

Within two hours of the announcement of the pope's handle, he had already garnered nearly 60,000 followers.

Burke said the handle @Pontifex was chosen because it not only means pope in Latin, but also bridge-builder, suggesting unity. How often will the pope tweet? "As often as he wants," Burke said, adding that he hoped the tweeting would be frequent and regular.

While the pope will push the button himself on Dec. 12, subsequent tweets will be sent by someone in the Vatican's secretariat of state. They will, however, all be approved by the pope, officials said.

"It's always going to have his engagement and his approval," said Monsignor Paul Tighe, the No. 2 in the Vatican's social communications office. "Not physically, but from his mind."

Currently a host of Twitter accounts use the pope's name, purporting to be his personal account. The @Pontifex account, however, is certified as the only official papal Twitter feed, Tighe said. No special security arrangements have been taken to prevent the account from being hacked; Burke said Twitter has many celebrity clients.

"They seem to be able to take care of them. We assume they'll be able to take care of us as well," he said.

Papal tweets will be sent simultaneously in English, French, Spanish, Portuguese, Italian, German, Polish and Arabic, Burke said. Monsignor Claudio Maria Celli, the president of the Vatican's social communications office, said he hoped to add Chinese.

He stressed that the papal tweets aren't to be considered infallible teachings, merely "pearls of wisdom" in the pope's own words.

The Vatican has been increasing its presence in social media, using YouTube channels and Facebook pages for special events and Twitter to engage believers and nonbelievers alike, particularly the young.

The Vatican decided against using a personal Facebook page for the pope because they thought it was too personal an interaction and would require more manpower to keep updated.

Wrong turn, then shock and horror at MIA




















What began as a day of prayer and fellowship turned into a surreal scene of stunned, bloodied passengers and twisted metal.

There was the sickening sound of crunching metal early Saturday as a busload of Jehovah’s Witnesses was low-bridged by a concrete overpass at Miami International Airport, peeling back the top of the vehicle “like a can of sardines.”

Airport workers running to the scene found shocked passengers thrown into the aisle or trapped in their seats by the wreckage.





Riders in the front rows were crushed — two of them killed, others seriously injured.

The driver of the bus, 47-year-old Ramon Ferreiro, took a wrong turn off LeJeune Road, entering the airport by mistake, then rolled past multiple yellow signs warning tall vehicles. He drove on, approaching an overpass whose sign said “8ft-6in”. The driver either didn’t see it, couldn’t read it, or realized it too late.

The bus stood 11 feet tall.

“The last thing he should have done is to keep going,” said Greg Chin, airport spokesman. “That goes against all logic.”

Ferreiro, whose driver’s seat was lower than those of the passengers, was not injured.

One passenger, 86-year-old Miami resident Serfin Castillo, was killed on impact, and all 31 others were taken by ambulance to local hospitals. Thirteen ended up at Jackson Memorial’s Ryder Trauma Center, where one of them, 56-year-old Francisco Urana of Miami, died shortly after arriving.

Three remained in critical condition Saturday night, and three had been released.

Luis Jimenez, 72, got a few stitches on his lip and hurt his hand. He said the group left the Sweetwater Kingdom Hall about 7 a.m., bound for West Palm Beach.

“I was sitting in the back when it happened,” Jimenez said. “We were on our way to an assembly and lost a brother today. I’m very sad.”

Delvis Lazo, 15, a neighbor and member of the same congregation, described Castillo as a “nice, old man.” He often saw Castillo at religious gatherings, and their families have known each other for more than 15 years.

The last time Lazo saw him was about two months ago, as he prepped for a talk before his congregation.

“He gave me a thumbs up, told me that everything was going to be all right,” he said.

The bus, one of three traveling to the Spanish-language general assembly on Saturday, had been contracted by the congregation, which has fewer than 150 members.

According to public records, the bus belongs to Miami Bus Service Corporation, a Miami company owned by Mayling and Alberto Hernandez that offers regularly scheduled service between South Florida and Gainesville, often used by University of Florida students. At the home address listed for the company and the owners, Mayling Hernandez told The Miami Herald that passenger safety is her primary concern.

“At this time I’m worried about the driver and the families of the victims. I’m praying for them,” she said. “My job is to worry about the safety of the passengers who are our clients. What we do requires a lot of responsibility. I didn’t know the passengers but that doesn’t mean I’m not suffering.”

Neighbor Armando Bacigalupi described the owners as “caring people” and said he had seen buses park briefly in front of the house.
